PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR SERVICE.

This document constitutes a legally binding agreement between you, the User, and 4urClass ("we," "us," or "our"), the owner and operator of the 4urclass.app website and services (the "Service").

By creating an account, or by viewing, accessing, or using the Service, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Service.

1. Definitions

  • "Service" refers to the web application, content, AI tools, and functionalities provided by 4urClass, including the AI quiz generator, quiz-taking features, and personalized assessments.
  • "User" ("you" or "your") refers to any individual who creates an account and uses the Service.
  • "User-Generated Content" (UGC) refers to any content you create or provide while using the Service, such as the prompts or text you input to generate a quiz.
  • "AI-Generated Content" refers to any content, including quizzes and personalized assessments, that is generated by the artificial intelligence systems within the Service.

2. User Accounts & Google Single Sign-On (SSO)

Account Creation: To access the full features of the Service, you must register for an account. You may register using Google Single Sign-On (SSO).

Data Collection via SSO: By registering with Google SSO, you grant us permission to access and use certain information from your Google account. In compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia, we explicitly state that we collect the following personal data:

  • Full Name
  • Email Address
  • Profile Photo

Purpose of Data Use: We use this information strictly for the following purposes:

  • To create, manage, and secure your User account.
  • To personalize your user experience.
  • To attribute content you create.
  • To communicate with you regarding your account and important updates to the Service.

Account Responsibility: You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Privacy Policy

Our commitment to your privacy is paramount. Our data collection and use practices are detailed in our Privacy Policy, which is governed by the Malaysian Personal Data Protection Act 2010 (PDPA). 4. User-Generated Content (UGC)

Ownership: You retain all intellectual property rights to the original content (UGC) that you create and input into the Service.

License to Us: By submitting UGC, you grant 4urClass a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, and display this content for the purpose of operating, providing, and improving the Service. This allows our AI to process your input and generate quizzes for you.

Prohibited Content: You agree not to submit any UGC that is unlawful, defamatory, infringing on any third-party rights (including copyright and trademark), obscene, or otherwise objectionable. We reserve the right to remove any UGC that violates these terms without notice.

5. AI-Generated Content & Personalized Assessments

Ownership: All rights, title, and interest in and to the AI-Generated Content, including all quizzes and personalized assessments created by the Service's AI, are the exclusive property of 4urClass.

License to You: We grant you a limited, non-exclusive, non-transferable license to use the AI-Generated Content for your personal, non-commercial, and educational purposes, subject to these Terms.

CRITICAL DISCLAIMER - ACCURACY AND USE
  • The AI-Generated Content is provided for informational and educational purposes only.
  • We do not guarantee the accuracy, completeness, currency, or reliability of any AI-Generated Content. The AI can make mistakes and generate incorrect or biased information.
  • The "Personalized Assessment" feature is an automated tool and is not a substitute for professional, medical, psychological, or educational advice. You should not rely on it for making critical decisions.
  • You are solely responsible for verifying the accuracy of the content and using it at your own risk.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any laws or regulations of Malaysia.
  • Infringe upon the intellectual property rights of others.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Distribute viruses, malware, or any other malicious code.
  • Scrape, harvest, or collect data from the Service without our express permission.

7. Intellectual Property

Excluding UGC and AI-Generated Content (as defined above), the Service and all its original content, features, branding, logos, and functionality are and will remain the exclusive property of 4urClass and are protected by Malaysian and international copyright, trademark, and other intellectual property laws.

8. Termination

By You: You may terminate your account at any time by following the procedures within the Service or by contacting us.

By Us: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including but not to a breach of these Terms and Conditions.

9. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permissible by Malaysian law, we disclaim all warranties, express or implied, including but not to warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall 4urClass, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service or the AI-Generated Content. Our total liability to you for any and all claims shall not exceed the amount you have paid us, if any, in the last six (6) months.

10. Indemnification

You agree to defend, indemnify, and hold harmless 4urClass and its employees, directors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not to legal fees) resulting from or arising out of your use of the Service or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts of Malaysia.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days' notice of any material changes, likely via email or a prominent notice on our Service. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
